1.Introduction

1.1 These terms and conditions govern the sale and purchase of products on our website.
1.2 In these terms and conditions: “we” refers to The Varietea Shop and “you” refers to our customer or potential customer.
1.3 The seller is The Varietea Shop.
1.4 A customer is defined as any person who purchases or expresses an intention to purchase products offered and sold by The Varietea Shop.
1.5 A contract between a seller and a buyer is a legally binding agreement in which the seller agrees to supply goods or services and the buyer agrees to pay for them.

 

2.Products

2.1 The advertising of products on our website serves as an “invitation to treat” and not as a contractual offer.
2.2 We may update the products offered on our website from time to time and do not commit to supplying any particular product or type of product on an ongoing basis.
2.3 Once products purchased by you from us are in your physical possession or in the possession of a person designated by you to receive them, they are at your risk.

 

3.Prices

3.1 Our prices are listed on our website.
3.2 We reserve the right to change the prices listed on our website from time to time. However, such changes will not affect contracts already concluded.

 

4.Payments

4.1 During the checkout process, you are required to pay the prices for the products you have ordered.
4.2 Payment may be made by any of the acceptable methods specified on our website at the time of purchase.
4.3 A contract between you and us will only be formed when we accept your order and receive payment in full from you.
4.4 Failure to pay any amount due under these Terms and Conditions may result in us retaining the Products ordered and/or terminating the contract of sale at any time by written notice to you.
4.5 In addition to the product price, you may be required to pay a delivery charge which will be notified to you prior to entering into the contract of sale.

 

5.Delivery

5.1 We will ensure that the products you purchase are delivered to the address you specify during the checkout process.

 

6.Cancellation Right

6.1 If there is a defect in the purchased goods, you have the right to contact The Varietea Shop with the claim.
6.2 We are responsible for delivering you a new product of the same type of goods that you have purchased from The Varietea Shop and which you have found to be defective, and our store will bear all delivery costs.
6.3 You can claim a full refund if we are unable to replace the goods, if a replacement fails or if we do not resolve the problem within a reasonable time.
6.4 If we have reason to doubt whether the defect is due to manufacturing problems or has been caused by you, experts will be consulted to determine the cause of the defect.
6.5 We may terminate a contract under these Terms and Conditions immediately by providing you with written notice of termination if you fail to pay any amount due on time and in full or if you commit a material breach of the contract.
6.6 We may also cancel a contract under these terms and conditions by providing written notice if we are prevented from performing the contract due to an event beyond our control. This includes, but is not limited to, the unavailability of raw materials, components or products, power failures, industrial disputes affecting third parties, government regulations, fire, flood, disaster, riot, terrorist attack or war.

 

7.Risk and ownership

7.1 The products you purchase from us are at your risk as soon as they are in your physical possession or in the possession of a person authorised by you to receive the delivery.
7.2 Ownership of a product you purchase from us will transfer to you upon delivery of the product and we have received all amounts due for the product, including shipping costs, in cleared funds.

 

8.Warranties and Representations

8.1 You warrant and represent to us that:
you are legally capable of entering into binding contracts;
you have full authority, power, and capacity to agree to these terms and conditions;
all the information you provide to us in connection with your order is true, accurate, complete, and non-misleading;
you will be able to take delivery of the products in accordance with these terms and conditions.
8.2 We warrant to you that:
we have the right to sell the products that you buy;
the products we sell to you are free from any charge or encumbrance, except as specified in these terms and conditions;
you shall enjoy quiet possession of the products you buy, except as specified in these terms and conditions;
the products you buy will correspond to any description published on our website; the products you buy will be of satisfactory quality.
8.3 All of our warranties and representations relating to the supply of products are set out in these terms and conditions. To the maximum extent permitted by applicable law, all other warranties and representations are expressly excluded.

 

9.Law and jurisdiction

9.1 These terms and conditions will be governed by and constructed in accordance with the legislation of the Republic of Estonia.
